Divorce Tips for Women
By Henry F. Lewis on February 07, 2021
Divorce is not considered an easy process for either spouse. However, even in today’s modern society, men are the primary income earners in nearly two-thirds of hetero marriages. This means that women are often at greater financial risk in a divorce. When children are involved in a marriage, the divorce process is complicated even further.
Divorce lawyers at Gardner & Lewis, LLP have assisted countless clients through divorce proceedings. They understand that a person’s actions during a divorce can make the process easier or more difficult. Here they offer some divorce tips for women that can help our Oakland, CA, clients as they navigate a divorce.
Create a Budget
Whether a woman is financially independent or not, it is important that she understand exactly the amount of money she will need to support herself (and any children) after a divorce. Creating a budget is a good way to see how much money is required each month to meet basic expenses such as:
- Car payment
- Cell phone bill
- Childcare costs
In addition to recurring monthly expenses, women should take into account expenses that may be paid less frequently, such as insurance and taxes.
Collect Financial Documents
When going through a divorce women need to have a clear picture of the debts and assets that they share with their spouse. The best way to do this is to collect copies of all financial documents. Documents may need to be shared with attorneys or the court, so they should be kept in a safe place. If possible, it is a good idea to keep a copy of important documents with a family member or close friend. Financial documents that may be pertinent in a divorce include:
- Bank statements
- Tax returns
- Credit card statements
- Loan statements (home, auto, student, etc.)
- Retirement and/or investment account statements
Review Any Prenuptial Agreement
Not all spouses sign a prenuptial agreement. However, if one is in place, we advise our Oakland clients to review it carefully. Unless the terms of the prenuptial agreement have been broken, the document is legal, and any terms set forth will be upheld.
Prioritize Your Needs
In a divorce it is easy to get caught up in the turmoil and argue over every little thing. Often spouses find themselves fighting about things that aren’t actually important to them. Before things get out of hand, we suggest our Oakland clients prioritize their needs/desires, and make a written list as a reminder. For instance, do you really need the bedroom furniture set, or is it more important that you get the spousal support you are seeking?
Hire an Experienced Lawyer
No matter how much thought, research, or preparation goes into a divorce, no one should go through it without legal counsel. An experienced divorce lawyer, such as those at Gardner & Lewis, LLP, understands the intricacies of family law and is prepared to look out for your best interest, so that you get a favorable divorce settlement.
