The initial actions that are taken can have long-term consequences as to how the case proceeds and ultimately the welfare of your children. If parents are unable to reach agreements regarding custody or time-share, the courts will make those decisions. Absent an emergency, before any judge will make a custody order, the parties must mediate their issues. This mediation is generally performed through county mediation services, although often the parties jointly stipulate to private mediators. In very difficult cases, the court may order a full custody evaluation; a rather lengthy, expensive, and intrusive process. On occasion, a special master or referee may be used to monitor a contentious custodial situation. This trained referee or master can then make recommendations to the court. On occasion, when appropriate, an attorney may be appointed for the minor child or children.
